These Terms of Service ("Terms") govern your access to and use of the website heyfake.com and the tools provided on it (collectively, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What HeyFake is
HeyFake is an online suite of UI mockup and content-creation generators that produce illustrative images of fictional messages, posts and conversations on popular platforms. The Service is intended for entertainment, social-media content creation, design mockups, UX research and education. HeyFake is offered both as free browser-based tools and as paid plans (see Section 8).
2. Eligibility
You must be at least 18 years old to use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation.
3. Acceptable use
You may use HeyFake to create content for:
- memes, skits and entertainment posts on social media;
- UI mockups, marketing assets, design portfolios and case studies;
- educational, journalistic and research illustrations clearly identified as fictional;
- storytelling, fiction and creative writing.
4. Prohibited use
You agree NOT to use HeyFake, or content produced with HeyFake, to:
- create, generate, display, distribute or request adult, NSFW, pornographic, sexually explicit or sexually-suggestive content of any kind. HeyFake does not permit the generation of adult or sexual content, and we may suspend or terminate accounts used for this purpose;
- impersonate, defame, harass, threaten, blackmail, dox, stalk or sexualise any real person;
- commit, facilitate or attempt fraud, scams, phishing, romance scams, fake financial proofs or any other deceptive financial conduct;
- fabricate evidence in legal, employment, immigration, academic or insurance proceedings;
- spread disinformation, election interference, hoaxes or content designed to mislead the public;
- produce sexual or sexually-suggestive content involving minors, or any content that violates child-safety laws;
- infringe intellectual-property rights, trademarks or rights of publicity of third parties;
- violate any applicable law or regulation, including export controls and sanctions;
- circumvent security controls or other technical protections;
- scrape, reverse-engineer or resell the Service or any substantial part of it;
- upload malware, attempt to disrupt the Service or probe its security.
We may suspend or terminate access to the Service, including paid plans and API keys, at our sole discretion if we believe these Terms have been breached.
5. Your responsibility for content
You are solely responsible for the content you generate, distribute or publish using HeyFake. HeyFake does not store the content you create; we do not pre-screen and we do not endorse any user-generated content. Where content produced with the Service is shared elsewhere, you are responsible for clearly labelling it as fictional or satirical when context requires.
6. Intellectual property and trademarks
HeyFake renders illustrative recreations of widely-recognised user interfaces (e.g. WhatsApp, iMessage, Twitter/X, Instagram, ChatGPT). Trademarks, logos and brand names belong to their respective owners and are used solely for nominative, illustrative and identification purposes. HeyFake is not affiliated with, endorsed by or sponsored by any of these companies.
The HeyFake name, design, code and original artwork are owned by us and protected by copyright and other intellectual-property laws.
7. Accounts and API keys
Some features require an account (created via email sign-in) and, for the API, an API key. You are responsible for keeping your account credentials and API keys confidential and for all activity that occurs under them. Do not share API keys publicly or embed them in client-side code. We may rotate or revoke keys for security or abuse reasons.
8. Paid plans and billing
Parts of the Service are offered under paid plans — currently a recurring subscription ("Pro") and a one-time / lifetime purchase ("Creator") — as described on our pricing page. By purchasing a plan you acknowledge and agree that:
- a paid plan grants access to specific features and, for the API, a monthly request quota, as described at checkout and on the pricing page; the free tier provides a limited monthly API quota, and video generation requires a paid plan;
- subscriptions renew automatically at the end of each billing period (monthly or yearly) until you cancel; one-time / lifetime purchases are charged once;
- prices are shown exclusive of taxes — applicable VAT, sales tax or similar is added at checkout and may vary by country — and payments are charged in USD;
- you can cancel at any time via the customer portal linked from your account page; cancellation stops future renewals and you keep access until the end of the current paid period;
- refunds are governed by our Refund Policy.
We may change plans, prices and features; changes to recurring prices will not affect the period you have already paid for. We may also change, suspend or discontinue parts of the Service, or introduce account-based controls, for reliability, abuse prevention or maintenance.
9. Payments and Merchant of Record
All payments for HeyFake are processed by Creem (Creem.io) acting as our Merchant of Record. This means Creem is the seller of record for your purchase and is responsible for billing, payment processing and the collection and remittance of applicable taxes. Your purchase is therefore also subject to Creem's terms and privacy policy. Your statutory rights as a consumer are unaffected.
10. Takedown and abuse reports (DMCA / DSA)
If you believe content produced with HeyFake infringes your rights, depicts you without consent, or otherwise violates these Terms, send a notice via our contact page or to [email protected] with: (a) identification of the content, (b) a description of the violation, (c) your contact details, and (d) a statement of good-faith belief that the use is unauthorised. We respond to verified requests within a reasonable timeframe.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.
12. Limitation of liability
To the maximum extent permitted by law, HeyFake and its operators are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profit, data or goodwill arising out of your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amounts you paid for the Service in the three (3) months preceding the event giving rise to the claim; where you have paid nothing, our maximum aggregate liability is limited to USD 10. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted by law.
13. Indemnity
You agree to indemnify and hold harmless HeyFake, its operators and affiliates from any claim, loss or expense (including reasonable legal fees) arising out of (i) your use of the Service, (ii) your violation of these Terms, or (iii) your violation of any law or third-party right.
14. Changes to the Service and Terms
We may modify or discontinue all or part of the Service at any time. We may update these Terms; the updated version applies as of the "Last updated" date above. Continued use after changes constitutes acceptance.
15. Governing law and disputes
Any purchase you make through the Service is sold by Creem as our Merchant of Record; the contract of sale and payment is governed by Creem's terms and the law stated therein. For everything else — your use of the free tools and the Service generally — we do not impose a foreign choice of law on you: the mandatory consumer-protection laws of your country of residence apply, and any dispute will be resolved on an individual basis. Nothing in these Terms removes statutory rights you have as a consumer.
